AiVA Systems — Terms of Service

1. Agreement
By subscribing to AiVA Systems (“Service”), you (“Customer”) agree to these Terms of Service.
AiVA exists to help you save time, increase revenue, and run your business automatically.
We provide the system — you control the results.
2. The Service
AiVA automates messaging, booking, and client follow-ups across WhatsApp, Facebook, and Instagram using GoHighLevel (“GHL”) technology.
You’re responsible for ensuring your use of the Service complies with Meta, GHL, and all local laws in your region.
3. Pricing
AiVA Systems operates on a private, usage-based subscription model.
Pricing is provided after opt-in, demo, or verification.
Base monthly rates start from a limited internal plan, with additional usage fees billed according to active message volume and platform costs (e.g., Meta and GHL message rates).
Payments are processed securely via Stripe.
Cancel anytime; no long-term contracts.
No refunds for completed billing cycles.
Note: Pricing information in these Terms is informational only and not a public offer or advertisement. AiVA Systems complies with GoHighLevel’s Minimum Advertised Pricing (MAP) policy.
4. Account Ownership
Your AiVA sub-account belongs to you.
You may cancel or transfer ownership at any time.
We reserve the right to suspend or terminate accounts that violate Meta or GHL policies.
5. Content & Messaging Compliance
You agree not to use AiVA for:
Spam, false advertising, or deceptive practices.
Illegal, harmful, or abusive content.
Messaging contacts without consent.
Violations may result in immediate account termination.
6. Cancellation & Termination
Cancel anytime from your AiVA dashboard or by emailing support.
Upon cancellation, your data will remain available for 30 days before permanent deletion.
7. Limitation of Liability
AiVA provides automation tools “as-is.”
We’re not liable for message delivery issues, API limitations, or third-party outages (e.g., Meta or GHL).
Our total liability will not exceed the amount paid in the past 30 days.
8. Performance Guarantee — “Or It’s Free.”
AiVA guarantees results.
If you provide all required onboarding materials and access, and AiVA does not automate your Calls, SMS, WhatsApp, Facebook, and Instagram DMs, your subscription is free until those automations are live.
This guarantee applies only when:
You’ve submitted all requested onboarding materials, forms, and account access.
AiVA has confirmed receipt of everything needed to activate automations.
Once automation is complete, regular billing resumes.
If AiVA doesn’t deliver — you don’t pay. Simple as that.
9. Updates
We may update these Terms periodically to reflect platform, pricing, or compliance changes.
You’ll be notified of significant updates before they take effect.
